Last Will and Testament of Ann Snook of Tewkesbury. Widow.

In the name of god amen I, Anne Snook of Tewkesbury in the county of Gloucester, widow, being of sound mind, memoey and understanding so make this my last will and testament in manner and form following, that is to say; first I direct and order all my just debts and funeral expenses and the chatrges of proving this my will to be paid and discharged by my executrix herinafter named out of my personal estate. I gived and bequeath unto Mary Smith, Samuel Smith and Ann Smith, three of the children of my cousin Thomas Smith late of Tewkesbury aforesaid, baker, deceased, the sum of forty pounds apiece to be paid them by my executrix within twelve months after my decease, without interest. Also I give to Richard Smith and Sarah Smith two other of the children of the said Thmas Smith, deceased, the sum of one hundred pounds apiece to be paid them by my executrix as they shall attain the age of twenty one years, with interest for the same, from after my death the rate of four pounds per centum per annum and in case the said Richard Smith and Sarah Smith, or either of them shall happen to die before they shall attain the age of twenty one years then I will the legacy or legacies of him, her or them so dying to his, her or their issue, if any, to be divided between them, share and share alike, at their respective age of twenty one years or I will and direct the legacy or legacies and the interest thereof to be paid or applied by my executrix or administrators for the use and benefit of such issue in their maintenance, education and placing them out apprentices and in case the said Richard Smith and Sarah Smith or either of them shall happen to die before they shall attain the age of twenty one years without leaving issue then I give the legacy or legacies of him, her or them so dying without issue to and amongst all the children of the said Thomas Smith, deceased, who shall be living at the death of the said Richard Smith or Sarah Smith to be equally divided between them share and share alike. I give to my cousin Mary Richards, the wife of Mr. Samuel Richards of Tewkesbury aforesaid the sum of forty pounds, to my cousin Hannah Dewguard the wife of Edward Dewguard and now or late of Tewkesbury aforesaid, shopkeeper, the sum of forty pounds, to my cousin Elizabeth of Upton upon Severn in the county of Worcester, spinster, the like sum of forty pounds, to my my cousin Richard Boulter of Eckington, in the said county of Worcester, yeoman, the like sum of forty pounds, to my cousin Elizabeth Glover, the wife of Richard Glover of Twyning in the said county of Gloucester, yeoman , the like sum of forty pounds, to my cousin William Dobbins, yeoman, the sum of twenty pounds. To my cousin Elizabeth Crosbury? wife of xxxxxx Crosbury? , now or late of the city of Worcester, the like sum of twenty pounds.To my cousin Sarah Parfit of London, widow, the sum of fifty pounds. To Mr. John Toms of Tewkesbury aforesaid the sum of five pounds and to my maid servant Sarah Richardson, who now lives with me, the sum of ten pounds which legacies by me before given and bequeathed for the payment of which no particular time is herein before specified, I will and direct shall be paid by my executrix to the several legatees within twelve calendar months next after my decease without interest. Also I give and devise unto the Robert George Hayward of Frocester in the said county of Gloucester, clerk, and his heirs, all that my messuage, tenement or Inn commonly called or known by the name or sign of the King's Head with the stables, buildings, garden, coal yard and appurtenances thereunto belonging, now in the possession of Francis Holland, Innkeeper and Samuel Tompkins? , malster as tenants thereof, situate, lying and being in the Barton Street in Tewkesbury aforesaid, and all that my messuage or tenement with the appurteenances adjoining to the said King's Head Inn, now in the possession of John ---ardine as tenant thereof and also all that my other messuage or tenement with the garden ground and appurtenances thereunto belonging and adjoining to the said coal yard now in the occupation Deborah Shepherd, widow, as tenant thereof to have and to hold the said messuages or tenements, stables, buildings, coal yard, garden ground, hrereditaments and premises with their appurtenancies unto and to the use of the said George Hayward his heirs and assigns for ever upon the trust and to and for the intents and purposes which after expressed and declared that is to say that the said George Hayward his heirs and assigns shall and do from time to time as there shall be occasion by and out of so much of the rents and profits of the said premises as shall be necessary, put and keep the said messuages or tenements and buildings in good and tenentable oreder and repair, and after the reparation thereof in trust to permit and suffer my cousin Hannah Fisher of Tewkesbury aforesaid, spinster, and her assigns to receive and take the residue and remainder of the rents, issues and profits of the said premises to her and their own use and benefit for and during the term of her natural life and from and immediately after her decease then in trust that he the said George Hayward his heirs and assigns shall and do as soon as conveniently may be sell, and dispose of the said messuages or tenements, hereditaments and premises herein before devised, for the best price or prices and for the most money that can be reasonably procured or obtained for the same, and pay and divide the money arising from by such sale to and amongst William Fisher Broadfield, now or late of Wolverhampton in the county of Stafford, son of William Broadfield late of Tewkesbury aforesaid, ship carpenter, by Elizabeth, his wife, deceased, and Sarah -------, wife of Richard --------- of Tewkesbury aforesaid, cordwainer, and Ann --------- of Tewkesbury aforesaid, widow, and ------ ------ blacksmith, deceased, in equal shares and proportions, and in case the said William Fisher Broadfeld, Sarah ------- and Ann ------ or any or either of them shall happen to die in the life time of the said ---------- Fisher, then in trust to pay the share or shares of him, her or them so dying, to his, her or their representative or representatives. Also I give and devise unto my dear grandaughter, Paulina Wintle, spinster, the daughter of Mrs. Paulina Hayward by her first husband Mr. John Wintle, deceased, all my lands, tenements, hereditaments and premises which I purchased of Mr. William Ashmead, situate, lying and being in the parish of Ashchurch in the said county of Gloucester, with their appurtenances, to have and to hold the said lands, tenements and hereditaments and premises with their appurtenances unto the said Paulina Wintle and her assigns, for and during the term of her natural life, without impeachment of or for any manner of waste, and from and after the decease of the said Paulina Wintle, then I give and devise the same premises with the appurtenances to the heirs of the body of the said Paulina Wintle lawfully to be begotten, and for want or in default of such issue, then I give and devise the same premises with the appurtenances unto and to the use of Joseph Francis Hayward, son of the said George Hayward, his heirs and assigns for ever. Also I give and devise unto my dear daughter in law, the said Paulina Hayward, the wife of the said George Hayward, all that my messuage or tenement, with the tenements, buildings, garden, hereditaments and premises thereunto belonging, situate, lying and being in the Barton Street in Tewkesbury aforesaid and now in my possession, and all that my messuage, tenement or Inn, commonly called or known by the name or sign of the Maidenhead, with the stables, buildings, yards and appurtenances thereunto belonging and usually held and enjoyed therewith, sitiate, lying and being in the said Barton Street in Tewkesbury aforesaid and all that those three stables, lying in an alley called Howells Alley in the Barton Street in Tewkesbury aforesaid, adjoining to the said Maidenhead Inn and now in the possession of Timothy Smith, innholder as tenant thereof, and all those my messuages, tenements and buildings and parts and parcels of garden ground, hereditaments and premises with the appurtenamces thereunto belonging, situate and lying in Tewkesbury aforesaid, now in the occupation of ------- Walter, Edward -----, Mary Simmonds, ------------ Whitehouse and William Ingram, and also all and singular other my messuages, lands, tenements, hereditaments and premises whatsoever, situate, lying and being in the parish of Tewkesbury in the said county of Gloucester or elsewhere with their appurtenances and the reversion and reversions thereof, to have and to hold the said messuages, lands, tenements, buildings, garden grounds, hereditaments and premises with their appurtenances , unto the said Paulina Hayward and her assigns for and during the term of her natural life, without impeachment of or for any manner of waste and from and immediately after her decease, then I give and devise the said messuages, lands, tenements and hereditaments and premises with their appurtenances, unto and to the use of the said George Hayward, his heirs and assigns for ever, upon the trusts, and to and for the intents and purposes herein after expressed and declared (that is to say) in trust that he, the said George Hayward, his heirs or assigns, shall and do as soon as conveniently may be after the decease of the said Paulina Hayward, sell and dispose of the said messuages, lands, tenements, hereditaments and premises for the best price or prices, and for the most money that can be reasonably procured or obtained for the same, and pay and divide the money arising by the sale thereof, to and amongst all and every the children of the said Paulina Hayward, whether by her first husband, Mr. John Wintle, deceased, her present husband and the said George Hayward, or any future or after taken husband, shall be living at the decease of the said Paulina Hayward, in equal shares and proportions, and in case either of the children of the said Paulina Hayward shall happen to die in her life time wanting issue of his, her or their body or bodies, then I will that the share or shares of such child or children so dying in the life time of the said Paulina Hayward, shall be paid and divided to and amongst the issue of such child or children in equal proportions at their age of twenty one years. And my will is and I do hereby direct that the said George Hayward, his heirs and assigns, shall apply and pay the interest and produce of any child or children's share of the money arising by sale if the said peremises to and for the use and benefit of such child or children during his, her or their minority as the said George Hayward, his heirs or assigns shall in his or their discretion think fit. Also I give and bequeath unto the said Paulina Hayward all the rest, residue and remainder of my money, securities for money, plate, linen,china, furniture, goods, chattels, effects and personal estate of what nature, kind or quality soever or wheresoever being not herein before disposed of, to hold the same personal estate unto the said Paulina Hayward, her executors, administrators and assigns as her and their own property for ever. And I do hereby will, direct and declare that the purchasers or puchaser of the messuages, lands, tenements, hereditaments and premises directed by this my will, to be sold and disposed of shall not be obliged to see to the application nor be accountable misapplication or nonapplication of the purchase or consideration money thereof, but that the receipt or receipts of the said George Hayward, his heirs and assigns, shall be a good and effectual discharge or good and effectual discharges to such purchaser or purchasers for his, her or their purchase and consideration money to all intents or purposes whatsoever. And also that it shall and may be lawful to and for the said George Hayward , his heirs and assigns to deduct and retain out of the money arising by the sale of my said messuages, lands, tenements, hereditaments and premises devised to him for that purpose as aforesaid, all such costs, charges and expenses that he or they shall sustain or be put unto by reason of such sale or in or about the execution of the trusts hereby in him and them reposed. And lastly I do hereby constitute and appoint the said Paulins Hayward, sole executrix of this my last will and testament, hereby revoking all former wills by me at any time heretobefore made. In witness whereof I, the said Ann Snook, the testatrix, have to this my last will and testament contained in and written upon five sheets of paper, set my hand to the four first, and my hand and seal to the last sheet, this sixteenth day of August in the year of our Lord one thousand seven hundred and eighty two.
