Last Will and Testament of Arthur Cooke of Tewkesbury. Yeoman.

Be it known unto all men by these present, that I, Arthur Cooke of Tewkesbury in the county of Gloucester, yeoman, for diverse good causes and consideration especially for the settling of my estate, which the Lord hath ---- me, and putting an end to all differences that may thereby hereafter arise, do make and ordain this, my Last Will and Testament in manner and form following: Viz: Imprimis I do give and bequeath unto my wife Ann Cooke all those two messuages or tenements and gardens and all other the appurtenances thereunto belonging now in the occupation of me, the said Arthur Cooke or my undertenants, and are situate in Tewkesbury aforesaid, in a street called St. Mary Street, for and during the term of her natural life, if she shall remain so long a widow, she keeping it in repair. But if it shall happen that after my decease she shall join herself in marriage with another man, then my will is that she shall lose and forfeit the said house and gardens with all the appurtenances, which shall be disposed of according as is hereinafter expressed. Item, I give and bequeath to my wife Ann Cooke all my household goods until my daughter Sarah Cooke do come to the age of sixteen years, if the said Ann shall remain so long a widow. Also I give to the said Ann, the best bed and brass pott with legs, one table board, three wine stools and one chair until my son Samuel Cooke shall attain unto the age of one and twenty years if she shall remain so long a widow. Item, after the decease or marriage of my said wife Ann those two messuages or tenements with the appurtanances unto my son Samuel Cooke and to his heirs forever. Also I do give and bequeath unto my son Samuel Cooke one hundred and fifty pounds to be paid to him by my executors hereinafter named when he shall attain unto the age of one and twenty years. Also I give unto my son Samuel after the decease or marriage of my said wife Ann the best bed, one brass pot with legs, one table board, one chair and the three wine stools. Item, I give and bequeath unto my daughter Sarah Cooke four score pounds to be paid to her by my executors hereinafter named when she shall attain unto the age of eighteen years. Item, I give and bequeath unto my daughter Elizabeth Cooke, four score pounds and the other half of all my household goods not before bequeathed to be paid and delivered to her when she shall attain to the age of eighteen years. Item, I do by this, my Last Will and Testament assign my daughter Sarah when she shall attain to the age of sixteen years and shall receive her portion as aforesaid to pay unto my wife Ann Cooke the sum of fifteen shillings yearly during the life of the said Ann if she shall remain so long a widow. Also I do hereby assign my daughter Elizabeth Cooke when she shall attain the age of sixteen years and shall receive her portion as aforeesaid to pay to my wife Ann Cooke the sum of fifteen shillings yearly during the life of the said Ann if she shall remain so long a widow. Also I do give to my son Samuel Cooke when he shall attain the age of one and twenty years and shall receive his portion as aforesaid to pay my wife Ann Cooke the sum of twenty shillings yearly during the life of the said Ann if she shall remain so long a widow. And if it shall so happen or come to pass that any or either of my children die before their portions given by this my Last Will and Testament becomes due and payable then I do hereby give and bequeath their said portion or
portions to be equally divided between the survivors, or if two die before their portions become due and payable then I give and bequeath their whole portions to the survivor of them . And if it shall happen that they all die their portions given by this my Last Will and Testament becomes due and payable and they leave no issue behind them, then I will and bequeath unto my five executors herinafter named the sum of five pounds a piece to and for their own proper use, and for all and singular the remainder and remainders of the abovesaid bequeathed portions of my children if they all die as aforesaid, I give and bequeath unto my executors hereinafter named to and for the use of the people called -------- to be laid out and improved by them for the use of the said people forever ---- to the intent that these things herein expressed may be duly executed the legacies well and truly paid and this my Last Will and Testament faithfully performed, i do nominate and appoint my trusty and well beloved friends Francis Jefferies of Tewkesbury in the county of Gloucester, mercer, Joseph Colchester? of ------- in the Parish of Forhamton in the county of Gloucester, husbandnan, Anthony ----- , of Tewkesbury in the county of Gloucester aforesaid, draper, Nathaniel ------- of Tewkesbury aforesaid, joiner, and Charles tovey of Tewkesbury aforesaid, malster, to be the whole and sole executors in trust for the use and benefit of my children of this my Last Will and Testament my body to bury my children to educate and place , my debts to recover and the legacies above bequeathed to pay as aforesaid giving to them and to the survivors or survivor of them the same power and authority, right and title in trust as I myself have or ought to have and for the better performance of this my Last Will and Testament and the paying of my debts to pay the above bequeathed legacies in manner and form aforesaid I do give and bequeath all my bills, bonds, money, plate, mortgages and leases unto mny executors aforesaid in trust as aforesaid and if any of the money d ue upon bond or otherwise be lost or miscarry in any bad hands what cost or charges soever shall be expended for the recovery of the same both if and the charges thereof shall be equally deducted out of the above bequeathed legacies. Item, I give unto my executors ten shillings apiece and I do hereby revoke and make void all former wills whatsoever.
