Last Will and Testament of Elizabeth Ludgrove of Tewkesbury. Widow.

This is theLast Will and Testamemt of me, Elizabeth Ludgrove of Tewkesbury, widow. First I direct that all my just debts and funeral and testamentary expenses shall be fully paid by my executrix, hereinafter named, as soon as conveniently can be after my decease. And I give and devise unto my daughter Ann Ludgrove and heirs, all my fourth part or share and all other my parts, shares, rights and interest in and to all those eight acres or thereabouts of land situate at Fiddington in the county of Gloucester now in the occupation of --- John Bullock, and also in and to all those five cottages, tenements with the gardens and appurtenances thereto belonging, situate at Tedington in the said county and now or late in the occupation of the parish officers of Tedington and Henry Whi----- and -------- Healing or their undertenants and all other my real estate to hold the same unto my said daughter and her heirs for ever upon trust that she my said daughter and her heirs do and shall from time to time or at any time or times during the natural life of my son Walter Grey, surgeon, at the discretion of the said Ann Ludgrove and her heirs, but without being in any manner answerable for the exercise of such discretion, lay out and apply and dispose of the rents and annual profits of the said shares, lands, cottages and premises or so much and such part of the same rents and profits only as she or they shall think fit in or towards providing the said Walter Grey Ludgrove with board, lodging, clothing or other necessities or other wise for his benefit in such manner and form as she or they shall think fit, with full power from time to time to permit the said rents and profits or any part thereof to accumulate for such time as she or they shall think proper, and form and after the dedcease of the said Walter Grey Ludgrove the said Ann Ludgrove her heirs and assigns for ever. And I give and bequeath uinto my said daughter all money, goods and personal estate and effects (if any) which I may have saved as my own and have any right to dispose of upon trust to convert into money such part thereof as may not already consist of money to lay out and invest the produce with any or other money I may be possessed of upon such security as she or they shall think proper and from time to time or at any time or times during the life of my said son at the discretion of my said daughter , her executors or dministrators but without being in any manner answerable for the exercise of such discretion, lay out, apply and dispose of the interest and annual produce of the same or as much thereof as she or they shall think fit in or towards providing my said son with board, lodging, clothing or other neccessities or otherwise for his benefit in such manner and form as she or they shall think fit with full power at any time or times to permit the said interest and produce or any part thereof to accumulate for such time as she or they shall think proper. And for and immediately after the decease of the said Walter Grey Ludgrove, the said principal monies so directed to be invested shall belong to the said Ann Ludgrove her executors and administrators as her and their own absolute property, and I hereby declare that in case the said Walter Grey Ludgrove shall at any time or times, sell, mortgage or part with or attempt to sell, mortgage or part with his interest under this my will in the said shares, cottages and premises or in the said monies directed to be interested or in any part of the same respectively then and immediately thereupon all and every the trusts hereby declared thereof respectively in favour of or for the benefit of him the said Walter Grey Ludgrove shall cease and be void so far as concerns the hereditaments unto the said premises or the part or parts thereof in which such interest of the said Walter Grey Ludgrove shall be sold or mortgaged or attempted to be sold or mortgaged in such case such hereditaments, lands and premises or the part or parts last mentioned shall immediately absolutely vest in and belong to the said Ann Ludgrove, her heirs, executors, administrators and assigns according to the nature and qualities thereof free from all trusts whatsoever. And I declare that notwithstanding the trusts hereby declared it shall be lawful for my said daughter her heirs or assigns at any time or times after my deceas and during the lifetime of my said son and at ------ their discretion to sell and dispose of the said shares, cottages and other premises hereby devised either by auction or private contract and either in lots or altogether for such price or prices as she or they shall think fit and convey the same to the purchaser or purchasers thereof with liberty to buy in the same or any part thereof at any sale and treat the receipt of the said Ann Ludgrove her heirs or assigns shall be a sufficient discharge to the purchaser or purchasers of the hereditaments and premises so to be sold who shall not be liable to see to the application of the same monies or be accountable for the misapplication thereof. And I direct that in case of any such sale the clear produce after deducting all expenses thereof shall be invested in such security or securities as my daoghter her heirs, executors or administrators shall think fit, and that during the life of my said son the interest thereof shall be held and applied upon the same trusts as are hereinbefore declared and be subject to the proviso hereinbefore contained respecting the premises so to be so and also that upon the decease or forfeiture of the said Walter Grey Ludgrove, the principal money so to be invested shall belong to the said Ann Ludgrove her heirs and assigns, and I further declare that the said Ann Ludgrove her heirs, executors or administrators shall be answerable or accountable only for so much money as shall actually come to her or their hands nor for any bnaker, broker or other person to whom in her or their discretion any of the trust monies shall be intrusted but only for wilful default , and also that it shall be lawful for her and them to deduct and retain out of any monies coming to her or their hands such costs and expenses as she or they may in any way be put to in the execution hereof. And lastly I appoint my said daughter Ann Ludgrove sole executrix of this my will in witness whereof I, the said Elizabeth Ludgrove, the testatrix, have to this my last will and testament contained in three sheets of paper subscribed my hand and to this third and last subscribed my hand and affixed my seal this sixth day of May one thousand eight hundred and thirty five.
