In the name of God Amen. the twenty eighth day of March Anno Domini 1643 in the nineteenth year of our soveraign Lord Charles, by the grace of God, of England, Scotland, Frannce and Ireland, defender of the faith. I, Elizabeth Smithsend of Tewkesbury in the county of Gloucester, widow, being weak in body but in good and perfect remembrance, all laud and praise be given to the Lord therefore, I do ordaine and make this my last will and testament in manner and form following that is to say. First, and principally I yield and comend my soul to God my creator and maker, and to Jesus Christ my saviour and redeemer by whose precious death, merits, and passion I hope to be saved, and my body to be buried in Chrisital burial. Item. I do give and bequeath all my free lands which I have, situate, lying and being in Homesdowne alias Hamond Downe in the parish of Ashchurch in the county of Gloucester unto Nicholas Smithsend my son and to his heirs, executors and assigns for ever. Item. I give and bequeath unto Elizabeth Smithsend, my daughter, the full sum of two hundred pounds to be given unto her within one month next after my decease. Item. I do give bequeath more unto the said Elizabeth Smithsend my daughter, all my wearing apparel my best featherbed and my best two feather pillows, --- pillow sleeves on --- flock bed, and one flock bolster, my best coverlet, one green rug, my best --- curtanes, two pair of my best blankets, one dozen and half of my best table napkins, my best --- table cloth, one pair of sheets laced thereon, the middle two pair of my flaxen sheets, three pair of hempen sheets, my brewing kettle, my biggest brass pot, half a dozen of my best pewter dishes, half a dozen --- , one press, one chest, one trunk, one ---- and one face cloth, my warming pan, one carpet and half a dozen of my best cushions. Item I do give and bequeath unto John Smythsend, my son, the full sum of one hundred pounds to be paid unto him at, in, or before the third day of May in the year of our Lord 1644. Item. I do give and bequeath unto Richard Smithsend, my son, the full sum of one hundred and fifty pounds to be paid unto him in manner and form following, that is, to be paid twenty pounds within one month next after my decease, fourscore pounds more upon the first day of November next ensuing the date hereof, and fifty pounds in and upon the Chrisday --- which shall be in the yeare of our Lord God 1644. Item, my will and mind is that the remainder of all the --- not before given and bequeathed, shall be equally divided amongst my three sons, Thomas Smithsend, John Smithsend and Richard Smithsend. Item. I do give and bequeath to the poor twenty shillings. The rest of my goods, cattels and chattels, not before given and bequeathed, my debts being paid and my funeral expenses defrayed, I do give and bequeath unto my said son, Thomas Smithsend, whom I do ordain and make my whole and sole executor of this my last will and testament. Lastly I do desire my beloved brother in law, Robert, my beloved kinsman John Edwardes, and my said son Nicholas Smithsend, to be my overseers of this my last will and testament. In wittness whereof I have hereunto put my hand and seal the said day above written.
