Last Will and Testament of Fanny Moore of Tewkesbury. Widow.

1856.

This is the Last Will and Testament of me, Fanny Moore of Tewkesbury in the county of Gloucester, widow. First I direct the payment of my just debts, funeral and testamentary expenses. I give, devise and bequeath all my money and securities for money and all other my estate and effects of every description unto Henry Browett, stationer, and Michael Smart, grocer, both of Tewkesbury aforesaid, their heirs and assigns upon trust to five hundred pounds, part thereof to invest the same in their names and pay and apply the income to arise therefrom fo my sister Elizabeth, wife of John Price of Offenham, Worcestershire, shoemaker, for her life for her sole and separate use and benefit, independently of and free from control. debts or engagements of her present or any future husband, her receipt alone notwithstanding her coverture to be a to be a sufficient discharge for the same. And from and after her decease upon trust to divide and pay the said trust fund unto and equally between and amongst such of her children as shall be living. And in case of the death of any child leaving issue, such issue shall receive the parents share. All the rest, residue and
remainder of my estate and effects after payment thereunto of the legacies hereinafter bequeathed, I give, devise and bequeath to my friend Mary Blair, wife of Richard Blair of the city of Gloucester, gentleman, absolutely I give to my wife Mary Anne, wife of,
William Healing of Offenham a legacyof nineteen guineas. I give to William Henry Price, natural son of my said niece Mary Anne Healing now aged nine years and upwards and resideing with my said sister Elizabeth Price a legacy of nineteen guineas. I give to my niece Eliza, wife of the said Henry Browett a legacy of one hundred pounds. I give to Sarah Jane Browett and Frances Ellen Browett, children of the said Henry Browett a legacy of twenty five pounds each. I give to my nephew, Samuel Bishop of Tewkesbnury aforesaid a legacy of nineteen guineas. I give to my niece, Frances Eccleshare, wife of William Eccleshare of Nottingham, a legacy of fifty pounds. I give to Mary Harbin, widow of Charles Harbin, late of Tewkesbury aforesaid, brewer, deceased a legacy of fifty pounds, and to each of my said trustees a legacy of nineteen guineas each. And I direct that the said legacies be paid as soon as convenient after my decease. I empower my trustees to give receipts for all monies and effects to be paid or delivered to them by virtue of my will. I declare that of my said trustees or either of them shall die or be unwilling to execute the trusts of my will it shall be lawful for the competent trustee for the time being to substitute by any writing under his hand, any fit person or persons in whom alone or as the case may be jointly with the surviving or continuing trustees, my trust estate shall be vested and the trustee or trustees for the time being of my will shall be competent to exercise the powers given to herin named. And I exempt every trustee of my will from liability for lossses occuring without hid own wilful default and authorize him to retain and allow to his cotrustee all expenses incidental to the trusteeship. And I appoint the said Henry Browett and Michael Smart executors of this my will in writing whereof I have hereunto subscribed my name the sixth day of February, one thousand eight hundred and fifty six.
