Last Will and Testament of George Hawkins of Tewkesbury. Haberdasher of Hats.

This is the Last Will and testament of me, George Hawkins of Tewkesbury in the county of Gloucester, haberdasher of hats, for the disposal of that estete in the world which it has pleased God to bless me with. First, I order and direct that all my debts and funeral expenses shall be fully paid and satisfied, and I give and devise unto my nephews, Henry Beesley and Joseph Beesley both of the city of Worcester, glovers, and their heirs, all that my messuage or tenement with the buildings, garden, orchard, closes of pasture ground, lands and appurtenances belonging thereto and therewith held and enjoyes, situate, lying and being in Woodmancot and the parish of Bishops Cleeve in the said county of Gloucester. Also all those my messuages or tenements with their appurtenances situate in Tewkesbury aforesaid and all other real estate whatsoever or wheresoever to hold to them the said Henry Beesley and Joseph Beesley, their heirs and assigns for ever, on trust that they and the survivor of them and the heirs of such survivor do and shall with all convenient speed, sell and dispose of all and every my said messuages, lands and estate either together or in parcels, and after retaining in their hands, money sufficient to satisfy and reimburse themselves for all trouble, travel costs and charges which they may have sustained or be put to in the execution of the trusts hereby reposed in them and also retaining for each of themselves one sixth part of the net money arising by the sale of my said messuages, lands and estate, do and shall pay and divide the residue thereof to and amongst the children of my late nephew Thomas Beesley, deceased, James Beesley and my nieces Hannah Beesley and Elizabeth Beesley, paying to each of them my said nephew James and my said nieces, one sixth part of such overplus money as soon as the same can be had and received, and paying the other sixth part thereof to the children of my said late nephew Thomas, equally as soon as they shall respectively have attained the age of twenty one years. And my will is that if any of them shall die before attaining that age, the share or shares thereof of him, her or them so dying shall go and be paid to the survivors or survivor of them. And all my ready money, money at interest and all my goods, chattels and personal estate of what kind or sort soever I give and bequeath unto my said nephews Henry Beesley and Joseph Beesley in trust that they and the survivors of them and the executors and administrators of such survivor do and shall with all convenient speed after my death, retaining in their hands money sufficient to satisfy themselves for their trouble and expenses as trustees and retaining also for each of themselves one sixth part thereof, pay, divide up and dispose of the other four sixth parts of my personal estate and net money arising therefrom unto and amongst the same persons in the same proportions in the same way and manner and at the same time and times and under the same contingency respectively the childen of my late nephew Thomas Beesley aas I have hereinbefore directed the surplus and net money arising by the sale of my real estate to be divided and disposed of. And my will is that the receipt or receipts of my said trustees or the survivor of them, or the heirs of such survivor under his or their hands respectively shall be a sufficient discharge for the purchasers of my said real estate or any part thereof for his, her or their respective purchase money without their being obliged to see to the application thereof. And that my said trustees shall not be answerable or accountable one of them for the other nor one for the acts or receipts of the other of them nor with or for the sale of any part of my estate not occasioned by their willful neglect or default. And hereby revoking all former wills by me at any time made I nominate and appoint my said nephews, Henry Beesley and Joseph Beesley joint executors of this my last will and testament. In witness whereof I have to these two sheets of paper containing my last will and testament set my hand, and to the last of them my hand and seal this twenty ninth day of March in the year od our Lord one thousand seven hundred and seventy six. Humphreys Dorothy Bayliss Charles Freeth Whereas I, the within named testator, George Hawkins, have in my will above and within written, directed that if any of the children of my late nephew, Thomas Beesley, deceased, shall die before attaining the age of twenty one years, the share or shares of the net money arising by the sale of my messuages, lands and real and personal estate of his, her or their so dying shall go and be paid to the survivors or survivor of them which direction and every other clause, matter and thing in my said will mentioned and contained, I do hereby ratify and confirm and. I do also further order and direct and my will is that in case all the children of my said late nephew, Thomas Beesley, shall die before attaining the said age of twenty one years and without leaving issue, having at his or her death, then and in that case the sixth part or share of the net produce of my said real and personal estate given to them as aforesaid shall go to and be equally divided between my nephews Henry Beesley and Joseph Beesley (trustees and executors named in my said will), my nephew James Beesley and my nieces Hannah Beesley and Elizabeth Beesley, their executors and administrators, and declare this to be a codicil or supplement to my said will within written, and direct it may be so accepted and taken.
