Last Will and Testament of Henry Fowke, esquire, of Tewkesbury.

This is the Last Will and Testament of Henry Fowke of Tewkesbury in the county of Gloucester, esquire. I give, devise and bequeath all my real and personal estate unto my brother in law the Reverend William George Maxwell Samuel Jones of Tewkesbury aforesaid, gentleman, the principal clerk of the firm of Lechmere and Company, bankers, and Edmund Warden Jones of Tewkesbury aforesaid, gentleman, their heirs, executors and assigns to for and upon the trusts that they the said William George Maxwell Samuel Jones and Edmund Warden Jones and the survivor of them and the heirs, executors and assigns of such survivor do and shall as soon as convenient after my decease, sell and dispose of all or so much of my said real and personal estate as will fully satisfy and discharge my just debts, funeral and testamentary expenses and all charges and costs attendant on the performance of the trusts of this my said last will and testament, and when and after such debts, expenses and costs shall be duly paid and satisfied do and shall stand seized and possessed of the residue and remainder of my real estate and the overplus or surplus of my personal estate if any, it being my will and meaning that my personal estate be first applied towards the payment of my just debts, funeral and testamentary expenses and charges attendant on the said trusts to and for the use and benefit of my dear wife Jane Charlotte, her heirs, executors, administrators and assigns for ever. And I hereby direct that the settled and usual clauses inserted in wills for sale of real estates under trusts shall be considered applicable to this my will, such as the sufficiency of receipts for consideration money by my trustees to purchasers of real estates, indemnities to trustees, allowances for all disbursements, costs and charges in and about the execution of the said trusts and the like. And I hereby charge my real and personal estate with the payment of thirty pounds by quarterly payments in the year to Mr. John Dick late of Tewkesbury but now of Walton Cardiff, late a linen draper, for and during the term of his natural life having some years ago received by voluntary subscription a consideration for such annuity. And I hereby give, devise annd bequeath all the manors, messuages, lands, tenements and real estate whatsoever which at the time of my decease I shall be solely seized or possessed of at or entitled unto or interested in, either in trust for any purposes or by way of mortgage, unto the said William George Maxwell Samuel Jones and Edmund Warden Jones, their heirs, executors, administrators and assigns respectively, according to the legal quality or qualities of such estates respectively, upon and for the trusts interests and purposes or under and subject to the provisions and conditions respectively which shall be subsisting in or considering such several estates at the time of my decease. And I do hereby constitute and appoint my said dear wife sole guardian of my children until they shall attain the age of twenty one years, but in case of her decease before they shall have respectively attained such age then I appoint my sister in law, Helen Frances Maxwell their sole guardian until they shall respectively attain that age. And lastly I do hereby nominate, constitute and appoint the said Willaim George Maxwell Samuel Jones and Edmund Warden Jones joint executors of this my last will and testament, revoking all other wills by me at any time heretofore made. In witness whereof I, the said Henry Fowke, the testator, have to this my last will and testament set my hand and seal this sixth day of August in the year of our Lord one thousand eight hundred and thirteen.
