Last Will of Henry Hale Smith of Tewkesbury. Yeoman.

This is the Last Will and Testament of me, Henry Hale Smith of Tewkesbury in the county of Gloucester, yeoman. First I direct full payment to be made of all my just debts and my funeral and testamentary expenses and I do hereby give and bequeath unto Joshua Thomas esquire and Peter Osborne, grocer, both of Tewkesbury aforesaid, all my personal estates of whatever nature, kind or quality, to hold to them upon trust to pay to my dear wife Dianna Hale an annuity of twenty pounds per annum during the term of her natural life or for so long a period as she shall continue my widow and unmarried. And I direct that my said wife shall have the use and enjoyment of all my household effects likewise to live in the house which I now dwell in, rent free for her life or widowhood as aforesaid. And from and immediately after the death or marriage of my said wife, I give, devise and bequeath all my real and personal estates to my son John, to hold to him, his heirs and assigns for ever. And I hereby give and bequeath to each of my trustees for the trouble they may be put to in carrying out the trusts of this my will. I direct my trustees to reimburse themselves all expenses they may incur. I give to my cousin William Yeats all my wearing apparel. I appoint the said Joshua Thomas and Peter Osborne executors of this my will. As witness my hand this seventh day of March one thousand eight hundred and fifty four.

This is a codicil to be taken to and from part of the last will and testament of me, Henry Hale Smith, dated the seventh day of March one thousand eight hundred and fifty four. Whereas I have given and bequeathed to my wife certain property that I shall die possessed of and after my decease to my son John Hale, now I do hereby declare that in the event of my said son John Hale departing this life without leaving lawful issue, that my kinsmen Robert Sallis and William Sallis and William Yeats, shall have and be entitled to the whole of my property in equal shares and proportions. As witness my hand this seventeenth day of June 1854.
