The Last Will and Testament of Henry Insall of Tewkesbury. Innkeeper.

1849.

           This is the last Will and Testament of me, Henry Insall of Tewkesbury, Innkeeper. I direct my just debts, judicial and testamentary expenese to be fully paid and I do hereby appoint Joseph Smith, corn dealer, and William Bridges, late hosier, both of Tewkesbury as executors thereof. Whereas I am seized or otherwise amongst other hereditaments of a row of thirteen houses with gardens and eleven workshops extending eastward and westward and situate in the Oldbury in Tewkesbury aforesaid and called Spring Gardens Row, I do hereby devise the first four of said houses with the gardens thereto and the first four of the workshops (being the west end) unto my daughter Maria Augusta Insall, her heirs and assigns for ever. And I devise the next succeeding four houses in the said row with the gardens and the next four workshops to my daughter Caroline Amelia Insall, her heirs and assignees for ever. And I devisde the three remaining workshops (being the east end of the said Row) unto my daughter Ellen Matilda Insall her heirs and assigns for ever. And I devise eight ------ cottages or tenements with the gardens, outoffices and buildings belonging thereto situate and being in the Gravel Walk in the Oldbury aforesaid unto my daughter Rose Sophia Insall her heirs and assigns for ever. And I devise to my son John Henry Insall his heirs and assigns for ever, the messuage and premises known by the name of the Sun Inn in the High Street, Tewkesbury, with all and singular the stables, outbuildings, gardens and appurtenences belonging thereto or ------ thereunto . And I devise to my daughter Charlotte Insall her heirs and assigns for ever, two messuages or dwelling houses and premises adjoining with ----- and situate at or near to the bottom of and fronting the Church Street in Tewkesbury aforesaid on the westward side and now in the respective occupation of Thomas Prew and my mother in law Elizabeth Insall. And I devise to my wife Sarah Insall for the period of her natural life, the messuage or dwelling house, malthouse garden and premises also situate in and fronting the Church Street in Tewkesbury aforesaid and now in the occupation of ------ ------- and after her decease I devise the same to my daughter Sarah Anne Insall her heirs and assigns for ever. I devise to the said Joseph Smith and William Bridges their heirs and assigns a cottage garden hereditaments and premises with the appurtenances thereto belonging, situate at the Long Green in the parish of Forthampton and Longdon. And also a dwelling house, workshop and premises with the appurtenances situate in the Double Alley, High Street, Tewkesbury, upon trust that they and said trustee or trustees for the time being acting in the execution of this my will, do and shall sell the same by auction or private contract either altogether or in parcels and under and subject to any special conditions to title or the evidence of title and do and shall enter into contracts and convey and ------ the same when sold with and to the purchaser or purchasers thereof in fee or other as may be directed. And shall give receipts to the purchaser or purchasers thereof for the purchase monies and which rece[pt or receipts shall fully exonerate and discharge the purchaser or purchasers from seeing to the application of his, her or their respective purchase monies and from being answerable or accountable for its misapplication. I direct my executors to rdeuce the whole of my Stock in Trade as an Innkeeper with money by a sale thereof and out of the produce of the sales hereinbefore directed I desire my executors and trustees to pay all my just debts, funeral expenses and to apply and dispose of the residue to my said wife, and to her I hereby bequeath all my household goods, plate, linen and china and all the Rest, Residue and Remainder of my Personal Estate whatsoever and do hereby ---- that my said wife shall receive the rents and profits of the several hereditaments and premises hereinbefore devised to my said children until they shall respectively obtain their several and respective ages of twenty one years. In order and to the intent that she shall bring up, educate and clothe my said children until they shall respectively attain the age of twenty one years and that she shall ensure the said hereditaments and premises from loss or damage by ---- and keep the same in good tenentable order and condition and I declare that if any or either of my said daughters or son shall die without attaining twenty one years of age the hereditaments and premises before devised to him, her or them so dying as well as any interest or estate which shall have come to any or either of them by this ----- shall go to and I hereby devise to any child or children I may happen to have after the date hereof in fee simple as tenants in common but, if there shall be no such after born child or children then the same shall go to the survivors and survivor of my before named daughters and son in equal shares and proportions as tenants in common in fee to whom I hereby accordingly devise the same And I devise ----- ------- -------- as trustee or mortgagee to the said Joseph Smith and William Bridges, their heirs and assigns upon the ----- and sibject to the equities affecting the same trust and mortgage estates? respectively and I revoke all my former testamentary dispositions.
