Last Will and Testament of Thomas Blizard of Tewkesbury. Gentleman.

This is the Last Will and Testament of me, Thomas Blizard of Tewkesbury in the county of Gloucester, gentleman. First, I desire to express my fervent gratitude to Almighty God for the unnumbered mercies he has bestowed upon me during a long life, and for the prosperity with which he has blessed me. I direct the payment of my just debts, funeral and testamentary expenses out of my personal estate. I give to Ann Tidmarsh the daughter of my late cousin Elizabeth Tidmarsh the sum of one hundred pounds. To Thomas Turner son of my deceased cousin Ann Turner the sum of nineteen guineas. To James Turner another son of the said Ann Turner the sum of thirty pounds. To my godson ------ Thomas son of Philip Thomas of Tewkesbury and to Eliza Rogers daughter of the late John Rogers of Cheltenham the sum of nineteen guineas each, and to the female servant who may be living with me at the time of my decease the sum of five pounds. I give to Ann the widow of Thomas Holland late of Tewkesbury aforesaid, stocking framework knitter, deceased, the sum of ten pounds and to each of her children the sum of ten pounds each. I give to my executor Joshua Thomas the sum of twenty five pounds. I give to my sister Ann Hemmimg? an annuity or yearly sum of one hundred pounds to be paid to her during her life, by equall quarterly payments, the first payment to be made at the expiration of three calendar months after my decease. I also give to the said Ann Hemming? during her life the messuage and premises in which I now reside, situate in the Gloucester Road, Tewkesbury. I give and devise to my nephew John Blizard Manning all my messuages, lands and hereditaments situate in the several parishes of Berrow, Birtsmorton and Bredon in the county of Worccester, and Ashchurch and Walton Cardiff in the county of Gloucester, to hold the same to the said John Blizard Manning , his heirs and assigns for ever. I give, devise and bequeath to my nieces, Eliza Manning, Sarah Manning and Ann ------ all my messuages, lands and hereditaments situate in the several parishes of ------ in the county of Worcester and Tewkesbury in the county of Gloucester of whatever tenure the same may be, and including that said messuage and premises in the Gloucester Road, Tewkesbury, after the decease of my said sister, to hold the same unto my said three nieces, Eliza Manning, Sarah Manning and Ann ---- their heurs, executors, administrators and assigns as tenants in common and not as joint tenants, and I direct that the share of the said Ann ----- in the said hereditaments shall be for her sole and separate use and benefit free from and independent of the debts, ------- or engagements of her present or any future husband, and as to all the rest and residue of my estate and effects of what nature or kind soever, that is to say, I give one equal fourth part thereof to my niece Eliza Manning, one other fourth part thereof to my niece Sarah Manning one other fourth part thereof to my nephew John Blizard Manning and I direct my executors to invest the remaining fourth part thereof upon government real or ------ real securities and to pay the annual increase thereof to my niece Ann ----- during her life for her sole and separate use and benefit free from and independent of the debts, ----- or engagements of her present or any future husband and on her decease to pay and divide the principal fund unto and amongst all her children who shall live to attain the age of twenty one years in equal shares and proportions and their respective executors, administrators and assigns. But if there shall be no children of this or the said Ann ----- who shall live to attain that age, then I give the said principal fund unto the the said Ann -----, her executors, administrators or assigns. I declare that the receipts of the trustees or trustee for the time being of this my will shall be good and effectual discharges for all monies payable to them or him under the trusts aforesaid, and that no person paying any monies to my said trustees or trustee and taking such receipt shall be answerable for the misapplication or nonapplication thereof. I also declare that the trustees or trustee for the time being of this my will shall be charged and chargeable only with such monies as they or he shall respectively actually realise by virtue of the trusts aforesaid and that one of them shall not be answerable for the other of them but esch for his own acts, receipts and defaults only, and that they shall not nor shall either of them be answerable for any misfortune , loss or damage which sh hll or may arise or happen to my said trust estate unless the same shall arise or happen from their or his wilful neglect or default and that it shall be lawful for my said trustees or trustee to reimburse themselves and himself all such costs, charges and expenses as they or he shall or may incur, sustain or be put unto in or about the execution of the trusts hereby created. And I appoint the said Thomas Blizard Manning and Joshua Thomas of Tewkesbury aforesaid, gentleman, joint executors of this my will and give and devise to them their heirs and assigns all estates and hereditaments vested in me as trustee or --------- subject to the equities, affecting the same respectively and revoking all former wills, codicils and trestamentary dispositions by me at any time heretofore made I declare this only to be my last will and testament in testimony whereof I have hereunto set my hand this twelfth day of February in the year one thousand eight hundred and fifty five.
