This is the Last Will and Testament of me, Thomas Chinn of Tewkesbury in the county of Gloucester, millwright, for the disposition of that estate which with I am blessed . First, I do hereby verify and confirm the settlement made by me on my wife Ann Chinn previous to my marriage with her, and every article, clause and covenant contained in the deeds of settlement. Also I give to my said dear wife the sum of eighty pounds to be paid her by my executors. hereinafter named, within six months next after my deceasse. Also I give and devise unto my son John Chinn, his heirs and assigns for ever, all that my messuage or tenement with the shops, buildings, hereditamenmts and appurtenances thereunto belonging, situate and being in the High Street in Tewkesbury aforesaid now in the occupation of Mr. John Kingsbury, hosier, and Timothy Fletcher, silversmith, with the shops and yard belonging to the said premises in my own possession, extending from the said street in front to the River Avon on the back part thereof, and all that my messuage or tenement near the River Avon now in the occupation of William Mann, fisherman, to have and to hold the said messuages or tenements, hereditaments and premises, unto and to the use of the said John Chinn, his heirs and assigns for ever, subject nevertheles to the payment of all such incumbrances as shall be charged thereon or affect the same at the time of my decease. Also I give and devise unto my son Thomas Chinn, his heirs and assigns for ever, all that close, piece or parcel of pasture ground with the appurtenances wherein now stands, or lately did stand a wiindmill, situate and being in the parish of Tewkesbury in the said county of Gloucester and now in my own possession, to have and to hold the said pasture ground, hereditaments and premises with the appurtenances, unto and to the use of the said Thomas Chinn, his heirs and assigns for ever, subject nevertheless to the estate for life which my said wife hath in the said close of pasture ground. Also I give and devise unto the said John Chinn and Thomas Chinn all and singular my messuages or tenements, hereditaments and premises with their appurtenances which I purchased of Mrs. Tabitha Laight, situate and lying near the Key Bridge in Tewkesbury aforesaid, to have and to hold the said last mentioned premises with their appurtenances unto and to the use of the said John Chinn and Thomas Chinn, their heirs and assigns for ever as tenants in common and not as joint tenants. And my will and meaning is that whatever debts he owes me on the day of executing this my will, such debts shall not be brought to account as part of my personal estate, but I give and bequeath each son the debt which shall appear at my decease to be due and owing to me on the day of the date of this my will . Also I give unto my said son Thomas Chinn all my wordly goods to and for his own use and benefit. Also I give and bequeath to ------ Bridges of the city of Hereford, millwright, all interest money that shall be due to me from him upon mortgag at my decease. Also I give and bequeath to my said sons John Chinn and Thomas Chinn, their executors, administrators and assigns, all the rest, residue and remainder of my moneys, securities for money, stock in trade, goods, chattels, effects and personal estate of what nature, kind or quality soever, subject and chargeable nevertheless with the payment of all my just debts, funeral expenses and the legacy aforesaid, to hold the same personal estate (chargeable as aforesaid) unto my said two sons, their executors, administrators and assigns to be equally divided between them, share and share alike. But in case my said son Thomas Chinn shall be willing and desirous to take to the whole or any part of my household goods and stock in trade at a fair appraisememnt to be made by two persons, one to be chosen by the said Thomas Chinn and the other by the said John Chinn , then my will is and I do hereby direct that he shall be at liberty to take the whole or any part thereof at such valuation and appraisement to be made and set thereon as aforesaid, he accounting to and paying my sasid son John Chinn for one full moiety or half part thereof. And lastly I do hereby constitute and appoint my said sons John chinn and Thomas Chinn joint executors of this my last will and testament hereby revoking all former wills by me at any time heretofore made. In witness whereof I, the said Thomas Chinn, the testaor, have to this, my last will and testament contained in and wrote upon two sheets of paper, put my hand to the first sheet and my hand and seal to this last sheet, the nineteenth day of September in the year of our Lord one thousand seven hundred and seventy four. A codicil to be annexed and to be taken as part and parcel of the last will and testament of me, Thomas Chinn of Tewkesbury in the county of Gloucester, millwright. Whereas I made in my last will and testament bearing date the nineteenth day of September one thousand seven hundred and seventy four given (amongst other things) the residue of my goods to my two sons John Chinn and Thomas Chinn, now I do hereby revoke such bequest to them of my said goods and I give and bequeath unto my dear wife Ann Chinn the use and ---- of my plate, linen, beds, furniture and household goods which shall be standing and being at my death in the messuage or tenement and buildings wherein I now dwell, situate and adjoining to the Plough Inn in Tewkesbury aforesaid, for the space of one whole year after my decease, without any interruption or molestation whatsoever from my said sons or either of them. And from and after the use and ----- thereof for that space of time I give and bequeath to my said wife, her executors, adminidtrators and assigns such part of my said plate, linen, beds, furniture and household goods in my said dwelling house and buildings thereunto belonging as she shall make choice of that shall amount to the value or sum of twenty pounds, and I will and direct that a fair and just appraisement or value shall be put upon the said plate, linen, beds, furniture and household goods by two persons to be nominated by my said wife, and my will and meaning is that this bequest to my said wife shall not be accepted or taken by her in lieu of the goods and personal estate she is or may be intitled to by virtue of her marriage settlement. And after such choice of my goods to the amount of twenty pounds by my said wife as aforesaid, I give the residue and remainder thereof to my said two sons, their executors, administrators and assigns to be equally divided between them. And whereas the sum of fifty pounds is due to the estate of Henry -------- late of Tewkesbury aforesaid, bargemaster, deceased, from me and my said son John Chinn secured by our joint bond, now I direct such bond debt to be paid jointly by my executors. In all other respects I do hereby ratify and confirm my said last will and testament in witness wherof I have to this codicil which I will and direct to be taken as part and parcel of my last will and testament, set my hand and seal this eleventh day of October in the year of our Lord one thousand seven hundred and seventy five.
