In the name of God amen I, Thomas Jeynes of Tewkesbury in the county of Gloucester, gentleman, do make my Last Will and Testament in manner and form following. First, I commend my soul into the hands of Almighty God hoping to be saved by the meritorious death and passion of Jesus Christ my blessed Saviour and Redeemer, and my body I commit to the earth to be decently interred at the discretion of my executrix hereinafter named, in or near, the grave of my late wife, and for my worldly estate, which God of his mercy hath given me, I dispose thereof as followeth, that is to say; I give, devise and bequeath unto my kinswoman Anne Jeynes, wife of John Jeynes of Tewkesbury aforesaid, chandler, all that my capital messuage or burgage where I now dwell (situate, lying and being in the Barton Street in Tewkesbury aforesaid) together with the malthouses, cisterns, utensils for malting, gardens, stables, outhouses and appurtenances thereunto belonging, and also all those my two tenements with the appurtenances now in the possession of Robert Slycer and Joan Tombs, lying and being on the east side of the messuage wherein I now dwell, and also all that my one other tenement with the appurtenances now in the possession of Thomas Symonds, lying on the west side of the messuage wherein I now dwell, together with the gardens and outhouses to the several tenements or any or either of them belonging or appurtaining, to have and to hold the same unto the said Anne Jeynes for and during the term of her natural life, and immediately from, and after her decease, I give and bequeath the same messuage, tenement and premises with the appurtenances, unto the said John Jeynes for and during the term of his natural life, and after the several deaths of the said Anne Jeynes and John Jeynes I give and bequeath the same unto John Jeynes (one of the sons of the said John Jeynes and Anne his wife) and to the heirs male of his body for ever, and for want of such issue I give and bequeath the same messuage, tenement and premises with the appurtenances unto Thomas Jeynes (one other of the sons of the said John Jeynes and Anne his wife) and the heirs male of his body for ever, and for want of such issue I give and bequeath the same premises unto Nathaniel Jeynes (one other of the sons of the said John Jeynes and Anne his wife) and the heirs male of his body for ever, and for want or in default of such issue, my will and meaning is the same messuage, tenements and premises shall come and remain unto my right heirs for ever. Item, I give, devise and bequeath unto my brother John Jeynes for and during the term of his natural life, all those my several tenements with the coal yards, gardens and appurtenances thereunto belonging (which I bought and purchased of Mr. John ----) lying and being in Barton Street aforesaid, and after the decease of my brother I give the same unto Margaret the wife of my said brother for and during the term of his natural life, and from and after their deceases I give and bequeath the same tenements and premises last mentioned unto John Jeynes (son of my said brother) and the heirs male of his body for ever, and for want of such issue I give and bequeath the same premises unto Samuel Jeynes (one other of the sons of my said brother) and the heirs male of his body for ever, and for want of such issue I give and bequeath the same premises unto the right heirs of my brother John Jeynes for ever. I give, devise and bequeath unto my kinsman William Jeynes son of my brother William Jeynes, deceased, and the heirs male of his body for ever, all those my several tenements with the appurtenances now in the possession of Thomas Sparkes, Anne Roberts, Katherine Smith, Elizabeth Tinker, Isaac Rose and Susana Wheeler provided nevetheless and it is my will and meaning that my kinsman the said Thomas Sparkes shall hold and enjoy for and during the term of his natural life the tenement and garden with the appurtenances now in his possession for and notwithstanding the devise aforesaid. Item, I give, devise and bequeath unto my kinsman Joseph Jeynes (son of my brother William Jeynes) and to the heirs male of his body for ever, all that my tenement with the garden and appurtenances thereto belonging now in the possession of his brother, William Jeynes and William Tombs. Item, I give, devise and bequeath unto my kinsman Thomas Jeynes, son of my brother Joseph Jeynes, deceased, the sum of fifty pounds of lawful money of England to be paid unto him by my executrix within one year after my decease. Item, I give unto my two kinswomen Prudence Wilkinson and Anne Rocks? and to my kinsman Henry Reeve ten pounds apiece to be paid in one year after my decease.Item, I give to the poor inhabitants of the town of Tewkesbury five pounds to be disposed of by my executrix, chiefly to those that dwell in the Barton Street. Item, I give unto my said Kinsman Thomas Sparkes the sum of ten pounds to be paid him when he comes to the age of fourteen. Item, I give unto my said kinswoman Anne Jeynes, wife of the said John Jeynes the table boards, bedsteads and all ------ and ------ ware that is in the house wherin I dwell, and it is my will and meaning that the same shall remain and be in the said house and be enjoyed from time to time by such person and persons as by force and virtue of this my will shall have and enjoy my said messuage or tenement wherein I now dwell as aforesaid. Item, I give and bequeath unto all the children of my brother John Jeynes ten shillings apiece and to all the children of my kinsman William and Joseph Jeynes ten shillings apiece. Item, i give unto all the children of my kinsman Ralph Jeynes of the Barton Street, baker, ten shillings apiece. And unto all the children of Ralph Jeynes of the High Street, baker, ten shillings apiece. Item, I give unto the children of my kinsman Samuel Jeynes of Northway ten shillings apiece. Item, I give and bequeath unto my cousins, John Jeynes, Isabell Jeynes and Anne Jeynes, son and daughterss of my said brother John Jeynes the sum of Fifty pounds of lawful money of England to be equally divided amongst them and paid unto them within one year after my decease. And it is my will and meaning that in case any person or persons to whom I have hereby devised any thing shall, at any time hereafter, sue another or trouble my executrix or her heirs for or in respect of her or their holding or enjoying any messuages, tenements or hereditaments by force or virtue of this my will, that then such person and persons shall lose the benefit of what I have hereby devised to them and the same shall come and remain to my executrix nevertheless that my executrix may not by virtue of this clause refuse or neglect to pay my legacies as they become due I declare that all and every such legatee and legatees by this my will as shall at the request, costs, and charges of my executrix release his, her or their right or pretended right and title in and to all and every part of the messuages, lands and tenements which I have hereby devised to my executrix, shall upon his, her or their executing such release as shall be entitled to have and receive his, her or their legacy hereby bequeathed all such time as the same as before herein allotted and appointed to be paid as aforesaid. All the rest and residue of my messuages, lands and tenements I give and bequeath unto the said Anne Jeynes and the heirs of her body for ever. And I do ordain and appoint my said kinswoman Anne Jeynes to be sole executrix of this my last will and testamnet hereby revoking and making void all mformer wills by me made and ordain and appoint this my last willm and testament. In testimony whereof I have hereunto put my hand and seal the twentieth day of April in the fourth year of the reign of our Sovereign Lord and Lady, King William and Queen Mary over England etc. Anno Domini 1692.
