Last Will and Testament of Walter Ludgrove of Tewkesbury. Mercer.

In the name of God amen I, Walter Ludgrove of Tewkesbury in the county of Gloucester, mercer and linen draper, being of sound and disposing mind, memory and understanding, thanks be to God for the same, make and ordain this, being my last will and testament in manner following, that is to say, first, it is my will that all my just debts, funeral and testamentary expenses shall be fully paid and satisfied by my executors and executrix hereinafter named. I give, devise and bequeath all that my freehold tenement and dwelling house with the appurtenances thereunto belonging, situate and being in the Barton Street in Tewkesbury aforesaid unto my dear wife, Elizabeth Ludgrove, for and during the term of her natural life, and from, and immediately after her decease then I give and bequeath the said tenement or dwelling house, garden and premises unto my son and daughter, John Ludgrove and Ann Ludgrove, their heirs and assigns for ever, equally to be divided between them as tenants in common and not as joint tenants. I give and bequeath all my stock in trade, household furniture, book debts and personal estate of what nature or kind soever unto my friends, James ---- of Hardwick in the parish of Bredon in the county of Worcester, gentleman, and Thomas Firkins of ------ in the said county of Worcester, gentleman, their executors and administrators upon trust in the first place to permit and suffer my said wife Elizabeth Ludgrove carry on and conduct the business of a mercer and linen draper now established by me in Tewkesbury aforesaid and to receive, take and retain all profit, benefit and advantage which may arise therefrom for their maintenance and support of herself and for the ----------- , support and education of all and every my dear children, Elizabeth Ludgrove, Ann Ludgrove, John Ludgrove and Walter Carey Ludgrove and such other my child or children who may be living at the time of my decease or born afterwards during their respective minorities and when and as soon as they, my said children shall ---- attain their respective ages of twenty one years, then --------------- permit and suffer my said wife Elizabreth Ludgrove to pay my said daughters and ------- the said ------------- to and for her own use and benefit during the term of her natural life ----- and immediately her deceasen then upon further trust that they, my said trustees or the survivors of them or the executors or administrators of such survivor do and shall absolutely sell and dispose of the said stock in trade, household furniture and personal estate and other effects and pay and equally divide the produce thereof unto all and every my said children Elizabeth Ludgrove, Ann Ludgrove, John Ludgrove and Walter Carey Ludgrove and such other chold or children as aforesaid, share and share alike, provided nevertheless that in case any or either of my said children shall happen to die during the life time of my said wife, leaving issue , then the share interest or proportion of his, her or them so dying and leaving issue shall go, belong and be paid his, her or their child or children in equal shares or proportions and shall not survive ------ amongst the rest of my said children as hereinbefore expressed and in case there shall be more of my children living at the time of my said wifes decease or being dead shall have no issue then I do hereby direct and declare that my said trustees or tustee for the time being shall stand possessed of and interested in such personal estate and effects unto and for such person or persons and in such shares or proportions as she, my said wife, Elizabeth Ludgrove by her last will and testament in writing to be by her only ---- and ----- shall give or bequeath the same. And my will is and I do further direct that in case it shall appear to them, my said trustees, James Gorle and Thomas Firkins and my said wife Elizabeth Ludgrove to be most advisable and proper for the benefit and advantage of her and my said children to discontinue the business hereeinbefore directed to be carried on, either during the minorities of any of my said children or during the lifetine of my said wife, then upon further trust that they, my said trustees or the survivor of them or the executors or administrators of such survivor, do and shall immediately thereupon, absolutely sell and dispose of the said stock in trade, household furniture, and personal estate and place out the monies arising therefrom upon government or other sufficient security or securities and pay and apply the interest and produce thereof unto and for the benefit and advantage of my said wife, Elizabeth Ludgrove, for and during the term of her natural life, and from and immediately after her decease then to pay and equally divide the same unto and amongst all and every my said children or their representatives, in manner hereinbefore directed with respect to the produce of my said personal estate, provided always, and it is my will, and I do hereby direct, that it shall and may be lawful to and for any said trustees or the survivor of them or his or their executors or administrators and out of the said trust monry or personal estate hereinbefore mentioned, to deduct and reimburse themselves or himself all such costs, damages and expenses as they, any or either of them shall ssustain or be put unto in the management and execution of the trusts hereby in them or him reposed, and that none of the said trustees, their heirs, executors or administrators shall be answerable or accountable for any ------ money than what they shall respectively receive under or by virtue of the trusts herein contained nor shall any of them be charged or chargeable with or accountable for the corrupt receipts of the other of them but each for his own acts, receipts and wilful defaults only. And lastly I do hereby constitute and appoint these my said trustees, James Gorle and Thomas Firkins and also my said wife, Elizabeth Ludgrove, executors and executrix of this my last will and testament hereby revoking all former wills by me made. In witness whereof I, the said Walter Carey Ludgrove, have to this my last will and testament contained in and written upon two sheets of paper, to the first sheet set my hand and to this, the second and last sheet, set my hand and seal this third day of December in the year of our lord one thousand eight hundred and seventeen.
