This is the last will and testament of me.William Merry the elder of Tekwebury in the county of Gloucester, yeoman, for the disposition of that estate in the world wherewith it has pleased God to bless me. First, I order and direct that all my just debts, funeral expenses and the charges of proving this my will shall be fully paid and satisfied by my executors hereinafter mentioned. I give and bequeath unto my daughter, Mary Tabitha Carless my son William Merry and my daughter Elizabeth Simpkins, wife of John Simpkins, in equal shares and proportions, the sum of eight hundred pounds stock in the -------- rents and all such other sum or sums of money which I may have or be ------- to in the three ----- rents at the time of my decease and which I purchased with the sum of five hundred pounds together with all interest that may be due to me at the time of my decease for or on account of such stock or sum or sums of money subject to the payment of twenty pounds to be paid out of my daughter Mary Tabitha Carloss's share to my grandaughter Martha Jeynes which I hereby give and bequeath to her. I give and bequeath unto Sarah --------- the sum of five pounds of lawful money of Great Britain to be paid to her by my executors hereinafter mentioned as soon as conveniently may be, but not to exceed twelve calendar months after my decease, the said five pounds to be deducted out of the legacy hereinbefore given to my daughter Mary Tabitha Carloss, William Merry and my daughter Elizabeth Simpkins in equal shares. Also I give and bequeath unto my daughter Ann Merry, her heirs and assigns for ever, all that my messuage or tenement situate and being in the Church Street in Tewkesbury aforesaid and now in my own occupation, together with the hereditaments and appurtenaces thereunto belonging, to hold unto her, my said daughter, Ann Merry, her heirs and assigns for ever, and also I give, devise and bequeath unto my said daughter Ann Merry, her executors, administrators and assigns, all and singular my household goods and implements of household -----, book debts, plate, silver, china and personal estate and effects of what nature, kind or sort soever the same may be or wheresoever the same now are or may at any time thereafter be situate, lying and being, tto hold unto my said daughter Ann Merry, her executors, administrators and assigns as her and their own property for ever. And hereby revoking all former wills by me at any time herebefore made, I nominate, constitute and appoint my friends Mr.John Ancill, yeoman, John Kedwards, gentleman, both of Tewkesbury aforesaid, joint executors of this my last will and teatament and it is my will and I hereby order and direct that my executors shall be paid and reimbursed out of my peresonal estate for all costs, charges, trouble and expenses and that they, nor either of them shall be answerable or accountable for any part of my personal estate but what shall actually come to their hands, nor shall one of them be accountable for the other of them nor for the acts, receipts or disbursements of the other of them, but each of them for his own acts, receipts and disbursements only. In witness whereof I, the said William Merry, the testator have to this my last will and testament contained in two sheets of paper, to the first sheet thereof set my hand and to this second and last sheet set my hand and seal this second day of September in the year of our Lord one thousand eight hundred and eighteen.
